Disclosure of Information and Your Responsibility to Provide Information.

It is important that you understand that any information, statements or answers made by you to us or your insurer (either verbally, in writing or on this website) are your responsibility and must be correct. Your attention is particularly drawn to the importance of the declaration as any failure to disclose facts material to the insurance or any inaccuracies in your answers may invalidate your insurance cover in part or in whole. Facts material to the insurance are matters or information which may influence your insurer as to the acceptability or otherwise of your Proposal or Renewal and must be disclosed immediately. You are advised to keep copies of documentation sent to or received from us for your own protection. Please do consult us if you are in doubt on any aspect.

You have a duty under the Insurance Act 2015 to make a fair presentation of the risk to insurers. This duty applies when You take out Your insurance cover, throughout the life of Your policy, and when You renew Your insurance. This duty includes a need for (IW) to undertake a reasonable search for material information which is known, or ought reasonably to be known, by Your company’s principals, directors, senior management (ie. anyone playing a significant role in making business decisions in Your firm) and staff responsible for insurance. You should advise Us of any particular concerns which led You to seek insurance cover and any special or unusual facts relating to the risk.

You must ensure that all material statements of fact are substantially correct and not misleading, and any material information which is a matter of expectation or belief (eg. an estimate or forecast) is provided in good faith. Failure to disclose any material information or change in circumstances to Your insurers which could influence the cost, or their decision to accept Your insurance, could mean that Your policy could be invalidated or cancelled without refund, or that part or all of a claim may be not be paid. ‘Material statements’ and ‘material information’ are information which could influence the judgement of a prudent insurer in determining whether to take on a risk and on what terms.

What Will You Have to Pay Us For Our Services?

We reserve the right to make charges in addition to any insurance premiums, for the arranging, amending, renewal and cancellation of any policy of insurance. These charges will always be advised to you before you purchase the insurance or they are incurred. Our inception or renewal fee will not exceed 27.5% (unless advised otherwise) of the insurers premium e.g.:

Insurers Premium=£100.00
Our Fee=£27.50
TOTAL AMOUNT PAYABLE=£127.50

We may receive an additional over rider commission or fee from some insurers or underwriters. This additional income could, for example, be based upon our overall account profitability with that insurer or a volume based over rider.
We also receive commission for arranging finance agreements for the payment of premiums and we may also receive commission or fees for passing introductions to other professionals.

Holding Clients Money

We will hold your premium (or part thereof) as agent for the insurance company. This money will be paid into our ‘statutory client’s bank account’ and will be rendered to the insurer in accordance with our terms of payment to the Insurer. Any interest earned on client money held by us will be retained by us for our own use rather than paid to you. We may transfer client money to another person, such as another broker or settlement agent, for the purpose of effecting a transaction on your behalf through that person.

Claims

It is an express condition of the Policy that all incidents that might give rise to a liability or claim under the policy must be reported to your Insurer immediately (or in any event, by the next business day) and thereafter in writing to enable a proper investigation to be carried out and a settlement agreed. Claims should be reported to your Insurer using the telephone number/address supplied and to Insurance World on fax number 01604 615410.

Are We Covered by the Financial Services Compensation Scheme (FSCS)?

5. Privacy Policy
5.1. IW are committed to protecting your privacy and to full compliance with the Data Protection Laws applicable to the UK. We use the information collected from you/your proposal form only to process and broker insurance proposals and to provide a more personalised service.
5.2. When you make a proposal for insurance through the Site you will need to provide details about yourself and the risk of cover required; we need to know your name, address, age and other personal details about you and any other persons included in the proposal. This allows us to process your proposal. We do not sell, transmit or pass on any of your proposal details to any third party company. The only exception being the actual insurer, underwriter, carrier or sub-agent who will be administering your policy.
6. Online Security
6.1. Although using the latest encryption technology to protect your credit/debit card details and all your personal information, the security of information and payments transmitted by the Internet cannot be guaranteed. Any losses incurred or sustained by users who transmit information by means of e-mail or other Internet link will be borne solely and exclusively by such user and in no event will any such losses in whole or part be borne by us.
7. Credit Card Payments
7.1. You may make payment by credit card in which event, credit card information is not stored on any part of our Site. Payment by credit card or otherwise will be due upon your acceptance of any quotation and is a condition of the insurance. You may have the option of purchasing insurance without submitting your card details but no cover can be put "on risk" until payment in cleared funds has been received and acknowledged in writing by or on behalf of the relevant insurer.
8. Quotations and Contract Formation
8.1. The content of our Site constitutes an invitation to treat and not an offer to insure. IW is an insurance intermediary and does not itself provide insurance. Your completed proposal form submitted via the web is likewise an invitation to treat. Upon receipt of your proposal, IW shall be entitled to submit the information contained on your proposal to insurers in order to process your proposal and obtain quotations. Any quotation made on your proposal shall constitute an offer made by the insurer specified in the quotation; capable of acceptance or rejection by you in accordance with the instructions provided on screen. The offer will be deemed to include the terms and conditions of the relevant insurer set out or referred to therein.
8.2. The insurance company gives all quotations on the basis of your insurance proposal/application form and acceptance and subject to any other terms set out in the insurance company’s terms. It is the proposer’s responsibility to answer all questions honestly and correctly and to disclose any material facts in the utmost good faith. No cover will be put on risk unless we are in receipt of a fully completed proposal form acceptable to the insurer and full payment has been made as instructed on the Site (where this facility is offered by IW).
8.3. You are warned that before accepting a quotation you should first read and understand the terms and conditions relating to that policy. The terms and conditions relating to the policy of insurance are accessible as instructed on the relevant part of the Site.
8.4. Cancellation
We are unable to cancel any insurance policy without your confirmation in writing that you wish to cancel the policy. We recommend that you retain your policy and cover notes carefully. Upon cancellation of the contract, it should be noted that some insurance companies apply short term cancellation charges which are not proportionate to the annual premium and as these form part of the contract offered, we would ask clients to realise that such charges upon cancellation are applied by the underwriters and not ourselves. All return of premium following cancellation or adjustment will be issued net of all our commission, inception and cancellation charges which we retain in full as remuneration for arranging the initial policy. Please note that our inception charges remunerate us for arranging the initial policy; we charge to handle all mid-term adjustments. Please note that a refund will be issued when the Insurers has confirmed cancellation and returned the unused policy premium to us. If a request for a refund is received a standard charge of £40.00 will be deducted from the return to cover administration and bank charges.
8.5. 'Cooling-off' period
In general, cancellation rights apply to non-investment insurance contracts taken out by retail customers (a retail customer is an individual who purchases an insurance policy for personal use such as private motor or household insurance; a commercial customer purchases insurance for their business); this cancellation right is generally not available to commercial customers. Your insurance policy will provide full details of any early cancellation rights that may apply to your policy.
9. Policy Documents
Policy documents will be issued to policyholders by the relevant insurer at the address stated on the proposal form by post or by email at their sole discretion. All policies and documents must be checked by you/the policyholder for accuracy and suitability. You are advised that any errors should be are notified to the issuing insurer promptly and in accordance with any terms of the policy. If you are in any doubt over any of the policy terms or conditions, please seek our advice promptly.
10. Refunds
You may be entitled to a refund in the event that an insurance policy does not meet your requirements but this will depend on the relevant insurance terms and your following any claim procedure set out in those terms for refunds. Your rights as a consumer are not affected.
11. What To Do If You Have a Complaint
